Welcome to BOXED Fitouts! The terms “we”, “us”, and “our” refer to BOXED Fitouts (ABN 50 179 004 158). We operate this website and online store, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use or access the Services.

1. Eligibility, Accounts & Information

You represent that you are at least the age of majority in your state or territory and, where applicable, have consent for any minor dependents using your devices to access the Services.
You agree to provide accurate and current information (including email, billing, payment, and shipping details) and to keep it up to date. You’re responsible for keeping your account credentials secure and for all activity on your account.

2. Products, Content & Availability

We aim to display our products accurately, but colours and finishes may vary depending on your device and settings.
Descriptions, specifications, and availability may change without notice. We may limit quantities or discontinue products at any time.

3. Orders & Cancellations

Your order is an offer to purchase. We may accept or decline it at our discretion. An order is accepted only once payment is processed and confirmation is sent.
Review your order carefully before submitting—cancellations may not be possible once processed.
Purchases are subject to our Refund and Returns Policy. You confirm your purchases are for personal use, not resale or export.

4. Prices, Taxes & Billing

Prices, discounts, and promotions may change without notice. The price at checkout applies at the time of order.
Prices are in Australian dollars (AUD) and exclude shipping, handling, customs, import duties, and taxes unless stated otherwise.
You authorise us and our payment provider to charge your selected payment method for all amounts due. You confirm that all payment details are true, correct, and authorised for use.

5. Shipping, Risk & Delivery

Delivery times are estimates only. We are not liable for delays caused by carriers, customs, or events outside our control.
Risk of loss and title pass to you once the order is handed to the carrier. For international orders, you are responsible for any import duties or taxes.

6. Installation, Safety & Use

Some products require assembly or installation. You are responsible for following provided instructions and ensuring proper installation and fastening to your vehicle in accordance with manufacturer guidance and local regulations.
Incorrect installation, misuse, or overloading may cause damage or injury. We are not responsible for damage or injury resulting from improper use or installation.

7. Intellectual Property

All content on our Services—including logos, designs, images, text, videos, and trademarks—is owned by BOXED Fitouts or its licensors and protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. No licence or ownership rights are transferred by accessing or using our Services.

8. Optional Tools & Third-Party Links

We may offer access to third-party tools or content, provided “as is” and without warranties. Use is at your own risk and subject to third-party terms.
We are not responsible for any third-party sites, content, products, or services.

9. Relationship with Shopify

BOXED Fitouts is powered by Shopify. All sales and purchases are made directly with BOXED Fitouts. Shopify is not responsible for any transactions or losses arising from purchases from us. You release Shopify from any claims related to your transactions with BOXED Fitouts.

10. Privacy

All personal information collected through our Services is handled in accordance with our Privacy Policy. Some information may be processed by Shopify or our partners in other countries to deliver and improve our Services.

11. Feedback & Reviews

If you submit ideas, reviews, or feedback, you grant us a worldwide, perpetual, royalty-free licence to use, reproduce, and display that content for any purpose. You warrant you own or control the rights to such feedback and that it complies with the law.

12. Errors & Corrections

We reserve the right to correct errors or inaccuracies and to update or cancel orders affected by such issues at any time without notice.

13. Prohibited Uses

You may not use our Services to:

  • Violate any laws or regulations;

  • Infringe intellectual property rights;

  • Transmit viruses or malware;

  • Spam or scrape data;

  • Harass, abuse, or harm others; or

  • Interfere with security or performance.

We may suspend or terminate access for violations at our discretion.

14. Mobile Messaging Terms (SMS Program)

The BOXED Fitouts mobile message service (the “Service”) is operated by BOXED Fitouts (“we”, “us”). Your use of the Service constitutes your agreement to these Mobile Terms.

We may modify or cancel the Service or these terms at any time. Continued use after updates constitutes acceptance.

Consent & Message Types

By consenting to BOXED Fitouts’ SMS/text messaging Service, you agree to receive recurring text messages from and on behalf of BOXED Fitouts to the mobile number you provide, including if your number is on a Do Not Call list. Messages may be sent using an automatic dialling system.
Promotional messages may include product updates, offers, or cart reminders.

No Purchase Required

You do not need to sign up for this program to make a purchase. Participation is voluntary.

Message Frequency & Charges

We do not charge for the Service, but message and data rates may apply. Message frequency varies depending on activity and preferences.

Opt-Out

You may opt out at any time by replying STOP to any message or using the unsubscribe option where available. You will receive a confirmation message.
If you have subscribed to multiple BOXED Fitouts SMS programs, you must opt out of each individually unless otherwise required by law.

Number Changes

If you change mobile numbers, you must re-subscribe with your new number. We are not responsible for messages sent to an outdated number.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Liability

To the extent permitted by law, we are not liable for failed, delayed, or misdirected delivery of messages, errors in message content, or actions you take or do not take based on the Service.

Privacy

We respect your privacy. See our Privacy Policy for details on how we collect and use your personal information, including through SMS marketing.

15. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any rights or guarantees you have under the Australian Consumer Law (ACL). Where permitted, our liability is limited to repair or replacement of goods, resupply of services, or the cost of doing so.

16. Disclaimer of Warranties

Except as required by the ACL or expressly stated by us, all Services and products are provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free use of the Services.

17. Limitation of Liability

To the fullest extent permitted by law, BOXED Fitouts and its affiliates, employees, and partners are not liable for any indirect, incidental, special, or consequential damages, including loss of profit, revenue, data, or goodwill, arising from use of the Services or products.

18. Indemnification

You agree to indemnify and hold harmless BOXED Fitouts, its affiliates, partners, and service providers from claims or damages resulting from your breach of these Terms or your misuse of the Services.

19. Severability

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in effect.

20. Waiver & Entire Agreement

Failure by us to enforce any provision is not a waiver. These Terms, together with any related policies, constitute the entire agreement between you and BOXED Fitouts.

21. Assignment

You may not assign or transfer these Terms without our written consent. We may assign or transfer our rights and obligations without notice.

22. Governing Law

These Terms are governed by the laws of Queensland, Australia. You consent to the exclusive jurisdiction of the courts located in Queensland.

23. Changes to Terms

We may update these Terms at any time. Changes will take effect when posted. Continued use of our Services after updates constitutes acceptance.

BOXED Fitouts

The BOXED Fitouts mobile message service (the "Service") is operated by BOXED Fitouts (“BOXED Fitouts”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to BOXED Fitouts’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of BOXED Fitouts through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with BOXED Fitouts. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to BOXED or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other BOXED Fitouts mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
